Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Sea Fire LLC (“Sea Fire,” “we,” “us,” or “our”), the operator of the Sea Fire website and services. By accessing or using our platform, which has provided unique flood risk and climate exposure data since its establishment in 2018, you agree to be bound by these Terms. We serve a community of discerning coastal property buyers and waterfront investors, and we draft these Terms with the inherent risks and opportunities of the scenic coastal market in mind.
Governing Law and Dispute Resolution: These Terms and any disputes arising from your use of our services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Wilmington, Delaware. You hereby consent to the personal jurisdiction of such courts. Any dispute shall first be submitted to confidential, binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, with the arbitration to be held in Wilmington, Delaware. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.
Modifications to Terms: Sea Fire reserves the right to modify, update, or amend these Terms at any time at our sole discretion. When we make material changes, we will make reasonable efforts to provide notice, such as by posting a prominent announcement on our Site or sending a notification to the email address associated with your account. Your continued use of the Sea Fire platform following the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms. We advise you to review these Terms periodically for any changes.
